Applies when using the Tutlio platform.
1. Service provider and scope
These internal rules (the Rules) govern the use of the Tutlio platform (the Platform). The service provider is MB Tutlio. By using the Platform, including registration, login, lesson scheduling, payments and subscriptions, you agree to these Rules and to the Privacy Policy. The Rules comply with the provisions of the Civil Code of the Republic of Lithuania, consumer rights protection laws, electronic services laws and payment services laws.
2. Registration and account
To use the Platform, you must register and agree to the Privacy Policy and these Terms of Use. You undertake to provide accurate and complete data and to update it when it changes. Your account is personal; keep your password secure and do not transfer it to third parties. You are responsible for actions carried out through your account.
3. Subscription and payments for tutors and organizations
Use of the Platform by tutors and organizations is paid, under a SaaS model. The standard individual subscription costs EUR 20 per month, unless another individually agreed B2B arrangement applies. Subscription payments are processed using third-party payment partners, such as Stripe.
- Cancellation: You may cancel your subscription in Settings or through the partner self-service portal. After cancellation, the subscription remains valid until the end of the current paid period; after that, access to paid features will be restricted.
- Switching to another plan: You may move to another plan, for example from monthly to annual, according to the procedure shown in the Platform; proportional calculations apply.
- Refunds: The refund policy complies with the Law on Consumer Rights Protection of the Republic of Lithuania. Specific cases are assessed individually by contacting info@tutlio.lt.
4. Organizations and companies
The Platform allows organizations, such as tutoring centers, schools and companies, to create accounts and centrally manage multiple tutors and students. Organization subscription prices, payment processing fees and terms may differ from those for individual tutors; specific terms are agreed individually by signing a service agreement.
5. Lesson cancellations and cancellation rules
The terms for lesson cancellations, such as the time remaining before the lesson and the percentage cancellation fee, are set directly by the tutor and/or organization; this information is visible in the student profile in the Platform. If a lesson is cancelled on time under the established rules, no fee may apply; if cancelled late, the set percentage fee for the lesson may apply.
6. Payments for lessons between the tutor and the student or parents
Payment for specific lessons is made directly for the services provided by the Tutor or Organization. For payment processing, the Platform uses licensed third-party payment service providers, such as Stripe for international card payments or UAB Perlas Finance for local online banking payments.
- Commercial agent status: MB Tutlio provides technical infrastructure and, when payments are made, acts exclusively as the authorized commercial agent of the Tutor / Organization for collecting funds. By paying through the Platform, the student or the student's parents/guardians properly fulfils the financial obligation to the Tutor / Organization.
- Payment model: The payer, meaning the student/parents, pays the lesson price and the platform administration transaction fee, which is clearly shown in the payment window before payment is made. The fee may vary depending on the selected payment method or the B2B agreement.
- Payment methods: One-time payment for each lesson separately; lesson packages purchased in advance for several lessons; monthly invoices for lessons completed during the reporting period.
The tutor/organization, and not MB Tutlio, is directly responsible to the student for providing the teaching services, their quality and the performance of obligations.
7. Additional features
The Platform offers additional features such as calendar synchronization with Google Calendar, a waiting list, and automatic email reminders about upcoming lessons and payments. Availability of these features may depend on the organization's subscription plan.
8. Data protection and GDPR compliance
Detailed information about data processing is provided in the Privacy Policy.
8.1. Responsibilities of the Data Controller and Data Processor
Under GDPR requirements, when processing students' personal data, the Tutor/Organization acts as the Data Controller, and MB Tutlio acts exclusively as the Data Processor providing cloud platform infrastructure. Each party has clearly defined responsibilities.
MB Tutlio's responsibilities as Data Processor: providing the Platform infrastructure and technical support; implementing organizational and technical security measures, including encryption, access control and backups; sending automatic notifications strictly according to the settings of the Tutor/Organization; notifying the Client of personal data breaches no later than within 72 hours under Article 33 GDPR; providing technical assistance to the Data Controller in exercising data subject rights, including access, deletion and export.
The Tutor/Organization's responsibilities as Data Controller: Legal basis: to have a legal basis for processing all student personal data entered into the Platform, such as consent, contract or legitimate interest; Information: to inform students and their parents/guardians about data processing in the Platform and provide a link to the Tutlio Privacy Policy; Data accuracy: to ensure that data entered into the Platform is accurate, complete and up to date; Data subject rights: to independently respond to students' requests concerning processing of their data using the tools provided by the Platform; Consent management: to obtain and manage the required consents, for example parental consents for organizing lessons for minors.
8.2. Additional obligations of the Tutor/Organization
By using the Platform and entering students' personal data, the Tutor/Organization undertakes to comply with all GDPR requirements and personal data protection laws of the Republic of Lithuania; promptly notify MB Tutlio of any observed data security incidents or breaches; use the Platform only for lawful purposes and not transfer login access to third parties.
8.3. Data Processing Agreement (DPA)
For B2B clients, namely organizations that sign service agreements, MB Tutlio provides a separate Data Processing Agreement appendix (DPA), which describes in detail the obligations of both parties, infrastructure security measures, lists of sub-processors and other GDPR requirements. 9. Prohibited activity and limitation of liability
It is prohibited to use the Platform for unlawful purposes, abuse accounts, distribute malicious software or otherwise violate laws. The service provider reserves the right to restrict or terminate access if these Rules are breached. To maintain business sustainability, MB Tutlio is not liable for indirect damages or loss of profit, and maximum liability is limited by the terms provided in the Platform or the B2B agreement.
10. Intellectual property and changes to services
The Platform content, design, software and trademark are the property of the service provider. The service provider may improve and change Platform features, prices or the Rules; existing clients will be informed in advance about significant changes by email or by notice in the Platform.
11. Disputes and governing law
Disputes are resolved by negotiation. Disagreements may be examined by the courts of the Republic of Lithuania; mandatory consumer rights protection provisions apply to consumers, meaning students/parents. These Rules are governed by the law of the Republic of Lithuania.
